Eesti tulumaksu juhend
Eesti tulumaks on otsene maks, mida maksustatakse üksikisikutelt sõltumata residentuuri staatusest.
Tulumaksumäär Eestis
Eestis ei ole progresseeruvat tulumaksusüsteemi. Füüsilistele isikutele sõltumata elukohast kohaldatav tulumaksumäär on 20%. Füüsilisest isikust ettevõtja tulumaksumäär on samuti 20%.
Tuludeklaratsioonid ja maksed
Eestis kogub, deklareerib ja maksab tulumaksu tööandja palgast kinnipidamise teel. Füüsilised isikud peaksid aga maksudeklaratsiooni esitama kord aastas alates 15. veebruarist (vorm A). Samas on füüsilisest isikust ettevõtjal igal juhul kohustus esitada tuludeklaratsioon (vorm E). Tulumaksu täitmise tähtaeg Eestis on aruandeaastale järgnev 30. aprill.
Maksudeklaratsiooni koostamisel kantakse maksudeklaratsiooni automaatselt Maksu- ja Tolliameti andmebaasi info maksumaksja tulude ja kulude kohta. Täidetud maksudeklaratsioonis saab märkida täiendavad tulud ja kulud.
Tulumaksu tasumise tähtpäev on maksustamisperioodile järgneva kalendriaasta 1. oktoober.
Füüsilisest isikust ettevõtja on kohustatud tasuma III kvartali tulumaksu avansilisi makseid 15. septembril ja IV kvartali eest 15. detsembril, kui eelmisel aastal saadi maksustatavat tulu. Üks ettemaks on 25% eelmise tegevusaasta ettevõtlustulult arvestatud tulumaksu summast.
Eestis mittemaksustatav miinimum
2024. aastal on kuni 14.400-eurose aastatuluga Eestis maksustatav tulu 7.848 eurot aastas või 654 eurot kuus. Mittemaksustatav tulu sõltub sissetuleku tasemest, vähenedes selle kasvades:
- Aastatuludel vahemikus 14.400 EUR kuni 25.200 EUR väheneb mittemaksustatav tulu vastavalt valemile 7.848 – 7.848 ÷ 10.800 × (tulu summa – 14.400);
- Aastatuludel, mis on üle 25.200 euro, on mittemaksustatav tulu null.
Vanaduspensioniikka jõudnud isiku mittemaksustatav tulu on 9.312 eurot aastas. Pensioniealise inimese jaoks on see summa alati stabiilne, isegi kui üksikisik pensioni ei saa.
Ettevõtja – füüsiline isik on vabastatud ettemaksu tasumisest esimesel tegevusaastal ja kui ühe ettemakse summa ei ületa 300 EUR.
Mahaarvamised
Eestis saab tulumaksu vähendada, kui maha arvata:
- Mittemaksustatav tulu;
- ettevõtlusega seotud kulud (maksustatava tulu või ettevõtluse arendamise eesmärgil);
- pensioniplaani sissemaksed (limiitideni);
- Hariduskulud (piirangi);
- Eluasemelaenu intressid;
- Kingitused ja annetused (limiidini).
Maksunumbri saamine Eestis
Eestis puudub maksumaksja identifitseerimisnumbri (TIN) süsteem. Siiski on kolme tüüpi identifitseerimiskoode:
- Ettevõtte registreerimiskood;
- Isikukood (isikukood);
- Mitteresidendi kood.
Füüsilisest isikust ettevõtjad, kes on asutanud Eestis püsiva tegevuskoha, peavad end registreerima Maksu- ja Tolliametis. Maksu- ja Tolliametis registreerimiseks tuleb üksikettevõtjalt esitada avaldus vormi R2 alusel. Taotlusele tuleb lisada järgmised dokumendid:
- Juriidilise isiku olemasolu kinnitus (nt väljavõte registrist);
- Vastutava isiku volituste kinnitus ettevõtte asukohas;
- vastutava isiku notariaalselt kinnitatud allkiri;
- Kirjalik leping maksuesindaja ja mitteresidendi vahel (vajadusel).

Enammakstud summade tagastamise kord
Enammakstud maksu tagastamine algatatakse tuludeklaratsiooni esitamisega. Tuludeklaratsiooni täitmisel on vaja esitada pangarekvisiidid, kuhu maksu enammakse tehakse. Tulumaksu tagastusotsuse on võimalik leida e-MTA e-teenuste keskkonnast.
Enammakstud tulumaksu tagastamise tähtpäev on maksustamisperioodile järgneva kalendriaasta 1. oktoober.
Karistus
Trahv tulumaksu hilinemise eest Eestis:
- Igapäevaselt 0,06% tasumata maksusummalt.
Trahv tuludeklaratsiooni esitamata jätmise eest Eestis:
- Eraisikutele 300 trahviühikut (hetkel 4 eurot ühik).
